The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. COVID-19 presents a myriad of challenges across systems of higher education concerning this highly contagious illness. Severe outcomes have been reported in some people, and people with a mild or even asymptomatic case of COVID-19 can spread the infection to others who may be more vulnerable.
While it is not possible to eliminate all risk of furthering the spread of COVID-19, Conquer Chiari (“CC”) has put in place preventative measures to reduce the spread of COVID-19, and it may implement others based on guidelines from federal, state, and local governments. However, despite these measures, CC cannot guarantee that the Participants and their families and guests, CC volunteers or CC staff will not become infected with COVID-19.
Participants recognize that their participation in CC-sponsored events, including group activities, as well as their families’ and guests’ presence/participation, carries some inherent risks. By signing below, the undersigned hereby asserts, on behalf of themselves, their families and their guests (collectively, “Participant Parties”) that their presence/participation in these activities is voluntary, and that they knowingly assume responsibility for all related risks. In particular, they are responsible for the Participant Parties’ safety during events.
The undersigned, on behalf of the Participant Parties, is aware of the risks associated with COVID-19 and that certain vulnerable individuals may have greater health risks associated with exposure to COVID-19, including individuals with serious underlying health conditions whose immune systems are compromised. While CC has taken and will continue to take steps to reduce the risks, the risk of serious illness, medical complications, and possible death does exist. The undersigned, on behalf of the Participant Parties understands that CC cannot guarantee safety or immunity from infection, but elects to participate in the CC event despite the risks.
By signing this form, the undersigned voluntarily agrees on behalf of the Participant Parties to release, covenant not to sue, discharge, and hold harmless CC, its Board of Directors, successors, assigns, officers, agents, employees, Participants, attorneys and representatives of and from injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense of any kind incurred by the Participant Parties due to COVID-19 (collectively, “Claims” and each a “Claim”).
The undersigned, on behalf of the Participant Parties, knowingly and freely assumes all of the foregoing risks, both known and unknown, even if arising from the negligence of others, and assumes full responsibility for participating in CC sponsored events during the COVID-19 pandemic. Notwithstanding anything in this agreement to the contrary, nothing herein is intended to release any claims that cannot be released by law.
The undersigned, on behalf of the Participant Parties, agrees to protect, defend, indemnify and hold harmless the CC (as well as its volunteers, participants, officers, directors, employees, representatives, attorneys, and insurers) regarding any of the Claims, and shall be liable to pay attorneys’ fees and costs incurred by CC or any of the foregoing persons mentioned in this paragraph in the event that any of the Participant Parties or any person on behalf of the Participant Parties bring a Claim that has been otherwise waived by this agreement.
By checking and completing the registration, I represent and agree that, on behalf of the Participant Parties, I understand the contents of and intend to be legally bound by this COVID-19 Assumption of the Risk and Waiver.
